- Vantage warrants each product that it sells against defects in material or workmanship for a full five (5) years from the date of purchase from Vantage, under the terms and conditions of this warranty, and subject to the exceptions provided below:
- touchscreen units (other than displays and display overlay components) are warranted for a period of twelve (12) months from the date of purchase from Vantage;
- power supplies, disk drives and other rotating mechanical parts, and pan/tilt heads are warranted for a period of six (6) months from date of purchase from Vantage;
- touchscreen displays, touchscreen display overlay components, batteries, custom products and products sold by Vantage but manufactured by other parties as identified in the literature accompanying such product are warranted for a period of ninety (90) days from date of purchase from Vantage; and
- incandescent lamps are not warranted.
Software products are not covered by this warranty. Limited warranties for software products, if any, are set forth in the applicable software license agreement accompanying such products.
- This warranty applies only to products that are purchased directly from authorized Vantage vendors, installers, dealers or representatives and that are installed by such authorized parties in accordance with Vantage installation instructions, product specifications and applicable construction codes and safety standards.
- Vantage products are warranted for normal use and this warranty does not cover (i) any product that has been used in any application other than that for which it was originally intended, (ii) any product that has been subjected to misuse, accidental damage, modification, improper installation, or repair or service by anyone other than an authorized Vantage vendor, installer, dealer or representative, (iii) any product problems caused by accessories, parts or components not supplied by Vantage, (iv) or any product that has had the serial number altered, defaced or removed.
- Pursuant to this warranty, Vantage will, at its option, (i) repair the product using new or refurbished parts or (ii) replace the product with a new or refurbished product. In the event of a defect, these are the exclusive remedies.
- Repaired or replaced equipment and parts supplied under this warranty shall be covered only through the unexpired portion of the original warranty for that equipment or parts.
- Labor is not covered under the Vantage warranty, including labor to uninstall or replace defective product. Owners of Vantage products should consult with their authorized vendor, installer, dealer or representative regarding any additional warranties offered by such party, including any warranties for labor.
- VANTAGE IS NOT LIABLE FOR ANY DAMAGES CAUSED BY ITS PRODUCTS OR FOR THE FAILURE OF PRODUCTS TO PERFORM, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOST SAVINGS, INDIRECT DAMAGES, INCIDENTAL DAMAGES OR CONSEQUENTIAL DAMAGES. Vantage’s liability on any claim in connection with its product shall never exceed the purchase price of the product. The above limitations of liability apply whether damages are sought, or a claim is made, under this warranty or as a tort claim (including negligence and strict product liability), a contract claim, or any other claim. These limitations of liability will be effective even if Vantage or a certified representative of Vantage has been advised of the possibility of such damages.
- EXCEPT AS EXPRESSLY SET FORTH IN THIS WARRANTY, VANTAGE MAKES NO OTHER WARRANTIES, EXPRESSED OR IMPLIED, NOR AUTHORIZES ANY OTHER PARTY TO OFFER ANY OTHER WARRANTY ON BEHALF OF VANTAGE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. VANTAGE EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS WARRANTY. No Vantage employee, vendor, installer, dealer or representative is authorized to make any modifications or additions to this warranty except by a document executed by an authorized Vantage corporate officer. Any implied warranties that may be imposed by law are limited to the terms of this warranty. This warranty supersedes all previous warranties. Some states do not allow exclusions or limitations of damages so the above exclusions and limitations may not apply to you. This warranty gives you specific legal rights and you may have other rights which vary from state to state.
- To obtain warranty service, contact your Vantage vendor, installer, dealer or representative within the applicable warranty period. This warranty does not apply to any claims made after the applicable warranty period.
- The law of the State of Utah, USA, without regard to its conflict-of-laws principles, governs the legal effect, meaning, construction and interpretation of this warranty.
